Terms of Service

These terms govern your use of Manaky Homes (the "Platform"), operated by Manaky, Inc.. By using the Platform you agree to these terms. If you do not agree, do not use the Platform.

1. What the Platform is — and is not

The Platform is a marketplace and information service that lets consumers compare licensed real estate agents by fee, service scope, and other publicly disclosed criteria.

The Platform is not a real estate brokerage. We do not:

Manaky, Inc. is not licensed as a real estate broker in any state. All agents listed on the Platform are independently licensed real estate professionals operating under their own brokerages.

2. Information accuracy

Listed agents are responsible for the accuracy of their own profile information, including pricing, service descriptions, and credentials. We make reasonable efforts to verify state license status against public records, but the Platform's information is provided "as is" without warranty of any kind.

Pricing examples and comparison calculations on the Platform are illustrative. Actual fees, rebates, taxes, and closing costs depend on the specific transaction and the agreement between you and the agent or brokerage you choose to engage.

3. Inquiries and introductions

If you submit an inquiry through the Platform, we forward your contact information to the agent(s) you select. The Platform does not represent you in any subsequent communication or negotiation. Any agreement you reach with an agent is solely between you and that agent or their brokerage.

We may receive a referral fee from the agent or their brokerage if you choose to engage them. Any such referral fee is disclosed to you before introduction. See our referral disclosure.

4. No fiduciary or agency relationship

Use of the Platform does not create a real estate agency, fiduciary, brokerage, or representation relationship between you and Manaky, Inc.. To establish a real estate agency relationship, you must enter into a written agreement directly with a licensed real estate broker, which Manaky, Inc. is not.

5. Permitted use

You may use the Platform for personal, non-commercial purposes. Commercial use, scraping at scale, redistribution of agent profile content for competing directories, or any use that violates applicable law is prohibited.

The publicly published agent-fee dataset, where offered, is licensed for free use including academic, journalistic, and commercial use, subject to the dataset license terms posted on the dataset page.

6. Equal Housing Opportunity

Manaky Homes supports the Fair Housing Act and equal opportunity in housing. We do not knowingly facilitate discrimination based on race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any other protected class.

7. Limitation of liability

To the maximum extent permitted by law, Manaky, Inc. is not liable for any decision you make in reliance on Platform information, for the conduct of any listed agent, or for the outcome of any real estate transaction. The Platform is provided "as is."

8. Changes

We may update these terms. Material changes will be posted with a revised "last updated" date. Continued use of the Platform after changes constitutes acceptance.
